Thank you for choosing HKZYPACK (operated by Shenzhen Zhiye Packaging Co., Ltd., hereinafter “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website hkzypack.com (the “Site”) and any custom flexible packaging services (“Services”). By using the Site or placing an order, you agree to be bound by these Terms.
1. Use of the Site
- You must be at least 18 years old or have legal authority to enter into contracts.
- You may use the Site only for lawful purposes and in accordance with these Terms.
- You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site without our express written permission.
2. Orders & Custom Packaging
- Minimum Order Quantity (MOQ): 500 pieces per design (unless otherwise agreed in writing).
- Quotation Validity: Quotes are valid for 30 days from the date of issue.
- Artwork Approval: You are responsible for final approval of digital proofs. Production begins only after your written confirmation.
- Color Tolerance: ±10% color variation is acceptable in mass production due to printing and material differences.
- Sample Policy: Free digital mock-up. Physical samples are free (shipping fee paid by customer). Samples are non-returnable.
3. Pricing & Payment
- All prices are in USD and exclude shipping, taxes, and duties unless stated as DDP.
- Deposit: 50% deposit required to start production; balance due before shipment.
- Accepted payment methods: T/T, PayPal, Western Union.
- Late payment may delay production and delivery.
4. Production & Lead Time
- Digital Proof: Within 24 hours after deposit and artwork received.
- Physical Sample: 7–10 business days.
- Mass Production: 15–25 business days after sample approval and balance payment.
- Lead times may vary during peak seasons or due to material shortages.
5. Shipping & Delivery
- We offer EXW, FOB Shenzhen, CIF, or DDP terms.
- Title and risk of loss pass to you upon delivery to the carrier.
- Customs duties, taxes, and clearance are your responsibility (except DDP shipments).
- Delivery dates are estimates; we are not liable for delays beyond our control.
6. Quality & Inspection
- All pouches comply with FDA, EU, and BRC food-contact standards.
- Tolerance: ±5% on quantity, ±3mm on dimensions, ±10% on material thickness.
- You must inspect goods within 7 days of receipt. Claims after this period will not be accepted.
- Defective rate ≤0.5% is considered acceptable. We will replace or refund defective units beyond this threshold.
7. Intellectual Property
- You warrant that your artwork does not infringe third-party IP rights.
- We retain the right to display produced pouches in our portfolio (without revealing your brand name if requested).
- All HKZYPACK trademarks, logos, and designs are our exclusive property.
8. Limitation of Liability
- Our maximum liability shall not exceed the total amount paid by you for the order.
- We are not liable for indirect, incidental, or consequential damages.
9. Force Majeure
We are not responsible for delays or failures caused by events beyond our control (e.g., natural disasters, pandemics, government actions, material shortages).
10. Governing Law
These Terms are governed by the laws of the People's Republic of China. Any disputes shall be resolved in Shenzhen courts.
11. Changes to Terms
We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance.
