HKZY Pack Terms of Service

Thank you for choosing HKZYPack, operated by Hong Kong ZhiYe Packaging Co., Ltd. (“HKZYPack,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of our website HKZYPack.com (the “Site”) and any custom flexible packaging products and services (collectively, the “Services”).
By accessing or using our Site or placing an order, you agree to be bound by these Terms.

1. Use of the Site

  • You must be at least 18 years old or have the legal authority to enter into a binding contract.

  • You agree to use the Site only for lawful purposes and in compliance with these Terms.

  • You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site without our prior written consent.

2. Orders & Custom Packaging

  • Minimum Order Quantity (MOQ): 500 pieces per design, unless otherwise agreed in writing.

  • Quotation Validity: All quotations are valid for 15 days from the date of issue.

  • Artwork Approval: Customers are responsible for final proof approval. Production will begin only after written confirmation.

  • Color Tolerance: A color variation of ±10% is considered acceptable due to printing and material differences.

  • Sample Policy: Free digital mock-up. Physical samples are free; shipping cost is paid by the customer. Samples are non-returnable.

  • Note: Final colors may vary slightly from on-screen previews due to monitor calibration differences.

3. Pricing & Payment

  • All prices are quoted in USD and exclude shipping, taxes, and customs duties unless specified as DDP.

  • Deposit: 50% deposit is required to start production; the remaining 50% must be paid before shipment.

  • Accepted Payment Methods: T/T, PayPal, Western Union.

  • Late payments may result in production or delivery delays.

4. Production & Lead Time

  • Digital Proof: Provided within 24 hours after deposit and artwork confirmation.

  • Physical Sample: 5–7 business days.

  • Mass Production: 10–15 business days after sample approval and balance payment.

  • Lead time may vary during peak seasons or due to material availability.

5. Shipping & Delivery

  • We offer EXW, FOB , CIF, or DDP delivery terms.

  • Title and risk of loss pass to the buyer once goods are delivered to the carrier.

  • Customs clearance, import taxes, and duties are the buyer’s responsibility (except for DDP shipments).

  • Delivery times are estimates only. HKZYPack is not liable for delays caused by carriers, customs, or force majeure events.

6. Quality & Inspection

  • All products comply with FDA, EU, and BRC food-contact safety standards.

  • Acceptable tolerances: ±5% in quantity, ±3mm in dimensions, ±10% in material thickness.

  • Goods must be inspected within 7 days of receipt. Claims made after this period will not be accepted.

  • A defective rate of ≤0.5% is considered acceptable. HKZYPack will replace or refund defective goods exceeding this threshold, subject to verification.

  • Replacement or refund applies only to defective goods confirmed by HKZYPack. Return shipping terms shall be mutually agreed.

7. Intellectual Property

  • You confirm that all logos, designs, and artwork provided to HKZYPack are legally owned or authorized for use.

  • HKZYPack shall not be liable for any intellectual property infringement arising from customer-provided materials.

  • We reserve the right to display non-branded samples of produced packaging in our portfolio or marketing materials unless otherwise requested in writing.

  • All HKZYPack trademarks, designs, and brand materials remain our exclusive property.

8. Limitation of Liability

  • HKZYPack’s total liability shall not exceed the total amount paid for the specific order giving rise to the claim.

  • We are not liable for any indirect, incidental, or consequential losses, including lost profits, revenue, or data.

9. Force Majeure

  • We are not responsible for delays or non-performance caused by circumstances beyond our control, including but not limited to natural disasters, pandemics, strikes, shipping disruptions, or government actions.

10. Governing Law

  • These Terms are governed by the laws of Hong Kong SAR.

  • Any disputes shall be submitted to the courts of Hong Kong for resolution.

11. Changes to Terms

  • HKZYPack reserves the right to update or modify these Terms at any time.

  • Continued use of the Site or Services after changes are posted constitutes your acceptance of the revised Terms.
